SignMyART – Terms of Service (UK)

Overview Welcome to SignMyART. The terms “we”, “us” and “our” refer to SignMyART. We operate this website and store, including all related information, content, features, tools, products and services (the “Services”). Our store is powered by WooCommerce, which enables us to provide the Services to you.

These Terms of Service, together with our referenced policies (the “Terms”), describe your rights and responsibilities when using our Services. By accessing, browsing, purchasing from, or interacting with our website or Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use our website or Services.

1. Company Information SignMyART is a UK-based business providing handmade, printed and engraved products, including personalised items.

2. Access & Account Responsibility By using our Services, you confirm that you are at least the age of majority in your country of residence, or you have permission to allow a minor dependent to use the Services under your responsibility. You may be required to provide information such as email, billing details, payment information and delivery details. You confirm that all provided information is accurate, current and complete. You are responsible for maintaining the confidentiality of your account and any activity that occurs under it. Accounts may not be transferred or shared.

3. Ordering & Personalisation Rules By placing an order, you make an offer to purchase subject to these Terms and UK consumer law.

  • Customer Typos: You are solely responsible for ensuring that all spelling, dates, and personalised details are entered exactly as you want them to appear. Personalisation is produced exactly as entered. We cannot offer free replacements or refunds for customer errors once production has started.
  • Order Modifications: If you realise you have made an error in your personalisation details, you must contact us at support@signmyart.co.uk within 2 hours of placing the order. Once this window has passed, or if design/production has already commenced, we cannot accept any changes.
  • Unresponsive Customers & Missing Information: If your order requires you to upload a digital file (e.g., handprints/pawprints) and you fail to provide this at checkout, or if we contact you requesting a higher quality image and do not receive a response within 30 days, we reserve the right to cancel your order. A small administrative fee may be deducted from your refund to cover payment gateway charges.
  • Order Acceptance: An order is only accepted once confirmed by email and payment is successfully processed. We may refuse an order, or cancel for pricing/product errors or failed payments.
  • Cancellations: Once production begins, cancellations may not be possible, particularly for personalised bespoke items. You confirm purchases are for personal use and not for resale.

4. Products & Descriptions We aim to display items accurately. However, appearance such as colour, shade, grain and engraving finish may vary due to screen settings, natural materials and production processes. We do not guarantee that products will exactly match online representations. We may change or discontinue products at any time and may limit quantities per customer or region.

Measurement & Scale Accuracy:

  • Reference Calibration: For carvings that require specific sizing (such as life-size handprints or pawprints), we rely entirely on the reference ruler or tape measure provided in your photograph.
  • Perspective Distortion: Please be aware that camera angles, lens distortion, and the positioning of the ruler can create “perspective shifts.” If a photo is taken at an angle rather than perfectly flat, the scale will be affected.
  • Artisan Tolerance: As these pieces are hand-finished and interpreted from 2D imagery, there is an Artisan Tolerance of up to 30% regarding final scale and measurement accuracy. By submitting your photo, you accept this margin of variance.
  • Visibility: If the measurements on your ruler are blurry, obscured, or angled away from the lens, our studio will use its best artistic judgment to estimate the scale.

5. Pricing, Payments & Third-Party Gateways Prices are in GBP unless stated otherwise. Prices may change, but confirmed orders remain fixed. Payment must be completed at checkout using available methods including PayPal and Klarna (where offered). Where third-party finance or payment services are used, your agreement is directly with that provider. Their terms and privacy policies apply. We are not responsible for declined payments, lending decisions, disputes with gateways, or failure to complete payments.

6. Production & Processing Times All items are handmade to order. Dispatch estimates may vary, particularly during busy periods or supply delays. We will notify you where significant delays occur.

7. Shipping & Delivery We deliver to the UK and selected international destinations. Delivery timeframes are estimates and not guaranteed. We are not liable for courier delays, customs delays or events beyond our control. Risk transfers to the customer when delivered to the address provided.

  • International Customs & Duties: For orders shipped outside the UK, the buyer is strictly responsible for any import duties, customs fees, or local taxes levied by their country.
  • Refusal to Pay Customs: If a buyer refuses to pay the required customs fees, the courier may return the parcel to our studio or abandon/destroy it at the border. Because our items are bespoke and cannot be resold, no refunds will be issued for the product or the original shipping costs.
  • Return Fees: If the courier returns the unpaid parcel to us and charges SignMyART a return shipping or administration fee, this cost will be legally owed by the buyer and deducted from any non-bespoke refunds, or billed directly.

8. Returns, Refunds & Cancellations Our policy follows the UK Consumer Contracts Regulations while offering an additional “Artisan Safety Net” for our customers.

  • Bespoke & Personalised Goods: Under UK law, personalised items are typically exempt from the standard 14-day return rule. However, to ensure you can order with absolute confidence, SignMyART offers a 14-day return window for a partial refund.
  • Artisan & Material Fee: A 30% artisan and material fee will be retained from the refund. This fee covers the loss of unrecoverable natural materials, bespoke studio production time, and non-refundable merchant transaction fees.
  • Bulk Orders: Orders of 5 or more identical or themed items (such as wedding favours, corporate gifts, or event plaques) are considered a “Custom Commission.” Due to the specific allocation of materials and studio time required for large-scale projects, these orders are strictly non-refundable once production has commenced.
  • Return Shipping: The cost of returning an item is the sole responsibility of the buyer and is non-reimbursable.
  • Shipping Recommendation: For your own protection, we strongly recommend using a fully tracked and insured service (e.g., Royal Mail Special Delivery) that covers the full value of the carving. SignMyART cannot process a refund for any items that are lost or damaged in transit back to the studio.

9. Intellectual Property & Copyright All poems, wording, designs, artwork, photographs, product concepts and website content are original works created by SignMyART and are protected under UK and international copyright law. You may not copy, reproduce, distribute, modify, publish, resell, or commercially exploit any part of our content without prior written permission. Unauthorised use may result in legal action. (Note: While our brand name is used for business identification, we do not currently claim registered trademark status.)

10. Faults, Damages & Issues We take great pride in our craftsmanship and packaging, but we understand that issues can occur during transit.

  • Notification Window: If your order arrives damaged or faulty, you must notify us within 24 hours of delivery.
  • Evidence Required: To process a resolution, we require reasonable evidence of the issue. Please provide clear photographs of the damaged item and the original packaging (including the shipping label).
  • Resolution: Once the 24-hour notification window and evidence are met, we will resolve the matter in line with UK consumer law, typically by offering a replacement or a refund for the affected goods.

11. Privacy, Data Protection & UK GDPR We process personal data in accordance with UK GDPR and the Data Protection Act 2018. Data is used to fulfil orders, provide service, prevent fraud and operate the business. We may share data with trusted service partners such as:

  • WooCommerce / WordPress Web Hosting
  • Payment processors (e.g. Klarna, PayPal)
  • Couriers
  • Fraud prevention services

We do not sell data. You have rights including access, correction, restriction and deletion where legally applicable. Contact support@signmyart.co.uk to exercise rights.

12. Third-Party Tools & Links We may offer optional tools via third parties. These are provided “as is” without warranties. Use is at your own risk and subject to the third party’s terms. Our Services may contain third-party links. We are not responsible for external content, accuracy or policies.

13. Website Use & Prohibited Conduct You must not use the Services unlawfully, misuse or disrupt the website, copy/scrape data, impersonate others, upload malicious content, harass, or post illegal content. We may suspend or restrict access for abusive or unlawful behaviour.

14. Feedback & Reviews If you submit feedback, reviews or suggestions, you grant us a licence to use this content for business purposes including marketing and service improvement, without obligation or compensation, provided it complies with law and does not infringe third-party rights.

15. Errors & Information Accuracy Occasionally errors may occur in descriptions, availability or pricing. We reserve the right to correct or cancel affected orders where necessary.

16. Limitation of Liability To the fullest extent permitted under UK law, SignMyART shall not be held liable for:

  • Customer Errors: Any errors in personalisation, including but not limited to typos, incorrect dates, or spelling mistakes provided by the customer.
  • Natural Material Variations: Variations in wood grain, colour, texture, or the presence of natural knots. As wood is a natural product, these are characteristics of the material and not considered faults.
  • Image Quality: Poor-quality outcomes resulting from low-resolution, blurry, or shadowed digital files/photos uploaded by the customer for engraving.
  • Courier Performance: Delays, missed deliveries, or handling issues caused by third-party courier services (Royal Mail, UPS, Parcelforce).
  • Transit Damage Reporting: Any damage reported after our 24-hour inspection window has closed.
  • General Losses: Any indirect, consequential, or economic losses arising from the use of our products or website.

17. Force Majeure We are not liable for events beyond our control including natural disasters, strikes, transport disruption, pandemics, technical failures or supplier issues.

18. Governing Law These Terms are governed by the laws of England and Wales. Any disputes shall be handled exclusively by the courts of England and Wales.

19. Changes to Terms We may update these Terms. Continued use constitutes acceptance.
